The “nullità di protezione” in the rulings of the European Court of Justice and in the recent judgments of the Joint Sections of the Italian Supreme Court The Italian legislator provides, as a consequence of the unfairness of a term in consumers contracts, the remedy of nullity, which can only occur to the advantage of the consumer, whereby the court has jurisdiction to declare the term void on its own motion.
